  • EFCA seeks to destroy employees’ rights to a free fair election regarding whether they want union representation.
  • EFCA will result in unfair bargaining since under its provisions, the initial labor agreement can be imposed by a federal arbitrator for two years.
  • EFCA imposes unreasonable penalties for even minimum violations of federal labor law.
